Who determines whether the Limited Use policy is applicable?

The determination of whether the Limited Use policy applies is the responsibility of the Unit Prevention Leader (UPL). The Limited Use policy, outlined in Army regulations, allows for certain circumstances where a soldier's information regarding substance use can be protected and not used against them in administrative actions if they come forward voluntarily for help.

The UPL is specifically trained to understand the nuances of substance use prevention and the associated policies. As such, they are in the best position to evaluate the situation, educate soldiers on their rights under the Limited Use policy, and guide them through the process. This role includes the assessment of whether an individual is eligible for the protections offered by this policy based on the specifics of their case.

In contrast, while the commander, medical officer, and First Sergeant play important roles in the overall health and disciplinary processes of the unit, they do not possess the specialized knowledge and authority concerning the Limited Use policy as designed for the UPL.
